Terms and Agreement | Official Rules

This agreement (hereinafter referred to as the "Agreement") governs the terms and conditions and official rules for participation in the "Trivia", "Spin Guaranteed Win" and "Bonus Cash" Giveaway (hereinafter referred to as the "Contest") provided by Fate And Fortune (hereinafter referred to as the "Company").

The Contest is open to individuals who comply with the eligibility requirements set forth in these Official Rules. Employees of the Company are not eligible to participate. Participants must be 18 years of age or older to enter the Contest. By participating, individuals affirm that they meet this age requirement. Participants must reside in one of the countries listed in section 12. Countries Accepted. Unfortunately, we are currently unable to accept participants residing outside of these countries.

The prize for the Contest is announced on our YouTube Game Show and website. The criteria are subjected to change at any time without notice. Please refer to the website for most updated information regarding the Prize(s).

The winner(s) will be selected based on the Contest theme. The winner will be notified via our YouTube Game Show within a week after the Contest ends.

Participants have 24 hours from the time of the announcement of the winner(s) on the YouTube Game show to claim their prize(s). Failure to claim within the specified time frame may result in forfeiture of the prize(s).

All federal, state, and local taxes, fees, and surcharges on prizes are the sole responsibility of the winner(s). Prizes are non-transferable and no substitution will be made except as provided herein at the Company's sole discretion.

The Company reserves the right to disqualify any participant suspected of engaging in fraudulent activity, cheating, or violating the terms of this Agreement. Such actions may include, but are not limited to, the use of automated systems, manipulation of the Contest, or any other conduct deemed inappropriate by the Company.

By entering the Contest, participants agree that any personal information provided may be used by the Company for the purposes of administering the Contest and for any other purposes consistent with the Company's Privacy Policy.

By participating in the Contest, participants agree to release and hold harmless the Company and its respective affiliates, subsidiaries, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such participant's participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error in the administration of the Contest or the processing of entries.

Except where prohibited, each participant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Wilmington, Delaware. All issues and questions concerning the construction, validity, interpretation, and enforceability of these terms and conditions and official rules, participant's rights and obligations, or the rights and obligations of the Company in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Delaware, without giving effect to any choice of law or conflict of law rules.

Participants from the following countries are eligible to participate in the Contest.

By participating in the Contest, participants agree to have read and abide by these terms and conditions and official rules. YouTube is not a sponsor of the Contest. Participants release YouTube from any liability related to this Contest. If you do not agree with any part of this Agreement, you are not permitted to participate in the Contest.
